Terms and Conditions for Parents and Carers

These Terms and Conditions govern the relationship between Primary SEN Consultancy (PSC) and the parent(s)/carer(s) (“You”) of any pupil (“Tutee”) receiving services arranged through PSC. By engaging services through PSC, you agree to the following:

1. Service Provision

PSC agrees to:

Match your child with a suitable, qualified tutor or specialist service based on their needs, goals and availability.

Manage all contractual and financial arrangements related to the tutoring or provision.

Ensure tutors and service providers hold up-to-date DBS checks and relevant qualifications.

Monitor the quality of provision and offer support to both families and tutors and services where needed.

2. Your Responsibilities

As a parent/carer, you agree to:

Provide accurate and up-to-date information about your child’s needs and circumstances.

Ensure your child is available, prepared and present for scheduled sessions.

Communicate openly and respectfully with PSC, tutors and specialist services

Inform PSC promptly of any concerns, changes or cancellations related to sessions

Respect the boundaries and professional role of the tutor or specialist.

3. Communication Protocol

All communication regarding session times, payments, progress or any concerns must go through PSC.

You must not negotiate directly with the tutor or specialist about rates, future tuition or any arrangements outside of PSC oversight.

Tutors and specialists are not permitted to continue tuition privately or separately without written permission from PSC.

4. Payment Terms

All payments for tuition must be made in advance of tutoring blocks and directly to PSC as per the issued invoices. 

PSC will handle all payments to the tutor or specialist; you do not need to pay the tutor directly.

Sessions cancelled with less than 24 hours’ notice may still be charged in full unless otherwise agreed in advance.

Any questions about billing or invoices must be directed to PSC, not to the tutor or specialist.

5. Safeguarding and Professional Standards

All sessions must be conducted in a safe, appropriate environment, whether in-person or online.

You agree to be present or reachable during sessions if the child is under the age of 16 or requires supervision.

PSC and its tutors and specialists follow strict safeguarding and confidentiality procedures. Any safeguarding concerns will be reported and handled according to legal obligations.

6. Non-Solicitation Clause

You agree not to engage the tutor or specialist independently or bypass PSC for a period of 12 months after the final PSC-arranged session.

This includes:

Offering direct tutoring employment

Arranging unpaid tutoring

Referring the tutor to friends, schools or other organisations outside of PSC

Breaching this clause may result in legal action to recover fees or damages.

7. Termination of Services

Sessions can be postponed within 24 hours notice and rearranged but sessions or blocks can not be refunded.

In cases of serious misconduct, safeguarding breaches or non-payment, PSC reserves the right to terminate the service with immediate effect.

8. Confidentiality and Data Protection

You agree not to share any personal, professional or financial information about the tutor, specialist or PSC with third parties without prior consent.

All personal data will be handled in accordance with GDPR and PSC and the tutor’s or specialist’s Privacy Policy.

9. Amendments

PSC may revise these Terms and Conditions as needed. You will be notified in writing of any changes, and continued use of the service implies acceptance of the updated terms.

10. Agreement and Signature

By engaging services through PSC, you confirm that you have read, understood and agree to abide by the above Terms and Conditions.
